Do I have A Carbon Monoxide Case?

If you suffered Carbon Monoxide Poisoning as a result of a boiler, stove, water heater or other appliance in your home, the first question that you should ask yourself is was this appliance maintained? Who was responsible for maintaining this appliance? Many times the person responsible for maintaining the appliance is the person who suffered Carbon Monoxide Poisoning. In those cases the responsible party is the person you see in the mirror. However, if you had a contract with a service company to maintain that appliance or boiler they may be responsible for the Carbon Monoxide Poisoning event.

If you suffered Carbon Monoxide Poisoning outside of your home, there is a strong possiblity that it was the result of someone else's negligence. If you are a renter and the landlord is responsible for maintaining the appliances, boiler or water heater they may be responsible for the Carbon Monoxide Poisoning event. In both of these cases whether or not someone else was legally responsible for you being poisoned by Carbon Monoxide will come down to whether or not they owed you a legal duty. In the case of your landlord, were they legally responsible to maintain the boiler or water heater? In the case of the service company you hired to maintain your water heater or boiler, did they do what they were supposed to maintain them? In these two situations you lease with the landlord and your service contract with the service company will be vitally important in determining if they are responsible for what happened to you.   

It will be important for you to know what caused your Carbon Monoxide Poisoning and whether anyone had a legal duty to you to prevent it.  The legal duty part will have to be determined with the assistance of an attorney. Many times there will be people or entities that are responsible for what happened to you that you do not know about. That is why it is important to consult with an attorney to ensure that a complete a thorough investigation is performed. 

Further, you will want to get a complete copy of all of your medical records related to your Carbon Monoxide Poisoning. These records will be invaluable to any attorney you consult with in determining whether or not you have a legitimate Carbon Monoxide Poisoning Case. If there was Police or Fire Department involvement in your Carbon Monoxide Poisoning you are also going to want to get copies of their reports as well.
